DictaMed legal
Terms of Use
Effective 5 September 2026 · Australia
1. Agreement and eligibility
These Terms govern access to DictaMed. By creating an account or using the service, you agree to these Terms and acknowledge the Privacy Policy. Accounts are intended for registered or otherwise authorised health practitioners aged 18 or over. You must provide accurate account and professional-registration information and keep it current.
2. What DictaMed provides
DictaMed is a temporary clinical documentation aid. It can transcribe speech, extract supplied text and organise information into practitioner-selected note templates. DictaMed is not a medical device for diagnosis or treatment, an emergency service, a prescribing system, an official patient record, a clinical archive or a substitute for professional judgement.
3. Practitioner responsibility
Every transcript, note and extracted item is an unverified draft. Before relying on or copying content, the practitioner must check it against the consultation and source material. Particular attention is required for patient identity, medicines, doses, allergies, negation, laterality, measurements, test results, diagnoses, follow-up and safety-netting. The practitioner remains solely responsible for clinical decisions and the final health record.
4. Patient information and consent
You must have lawful authority to submit information to DictaMed and comply with applicable privacy, health-record, surveillance, consent, professional and workplace requirements. DictaMed provides an optional consent control so you can record that consent was obtained when appropriate; the practitioner remains responsible for obtaining and documenting any consent required in their location or organisation. Doctor-only dictation must still be performed in a suitably private environment.
5. Accounts and security
Accounts are personal and must not be shared. You must protect your email account, passcode and devices; use accurate contact details; and notify DictaMed promptly of suspected compromise. DictaMed may require re-verification, expire sessions, temporarily lock access after failed attempts or suspend an account where reasonably necessary to protect users, patients or the service.
6. Temporary drafts
Clinical drafts are designed to expire automatically no later than 24 hours after creation and may be deleted earlier by the practitioner. You must export required content to your authorised clinical system promptly. DictaMed does not promise recovery of expired, deleted or otherwise unavailable drafts and must not be used as the sole copy of a clinical record.
7. Acceptable use
You must not use DictaMed unlawfully; impersonate another practitioner; access another account; introduce malware; probe or defeat security controls; reverse engineer protected service components except where law permits; overload the service; submit information you are not authorised to process; use generated content without professional review; or use the service to train or create a competing model through automated extraction.
8. Plans, trials and payment
Plan features, prices and included usage are shown before purchase. Unless stated otherwise, subscriptions are billed in Australian dollars through Stripe and renew automatically for the selected billing period until cancelled. Taxes may apply. Trials and promotional codes have the duration and conditions shown when activated and may convert to a paid subscription only where this is clearly disclosed and authorised.
9. Cancellation and plan changes
You may manage or cancel an eligible subscription through the Subscription area or by contacting support. Cancellation takes effect at the end of the paid billing period unless the checkout terms state otherwise. Refunds are not provided for change of mind except where required by law. We will give reasonable notice of material price or plan changes.
10. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Maintenance, provider outages, internet conditions, security events and legal requirements may affect access. We may improve, replace or discontinue features, taking reasonable steps to notify users where a change materially reduces a paid service.
11. Suspension and termination
We may restrict or suspend access where there is suspected misuse, non-payment, material breach, security risk or legal requirement. Where appropriate, we will provide notice and an opportunity to remedy. You may stop using DictaMed at any time. Expired temporary drafts cannot be restored after termination. Provisions that by nature should continue—including payment, responsibility, confidentiality and liability terms—survive.
12. Intellectual property and feedback
DictaMed and its software, design and branding are protected by intellectual-property laws. You retain rights in information you lawfully submit. You grant DictaMed a limited right to process that information solely to provide, secure and support the service. If you provide product feedback, we may use it without identifying patients or breaching confidentiality.
13. Liability and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies guarantees, rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law. To the extent permitted by law, DictaMed is not liable for loss caused by unreviewed generated content, failure to transfer a temporary draft to the official record or unauthorised account use. Any permitted limitation will be applied only to the extent reasonable and lawful.
14. Governing terms and contact
These Terms are governed by the laws applicable in Queensland, Australia, subject to any mandatory law that applies elsewhere. Before commencing formal proceedings, the parties should attempt in good faith to resolve the concern. Questions, notices, support requests and privacy matters may be sent to joedmiso@pharmacia.com.au.
